Understanding the AI Act

Artificial Intelligence (AI) has rapidly become integral to various sectors, from healthcare and finance to transportation and entertainment. However, its widespread use has also raised safety, ethics, and human rights concerns. 

To address these issues and ensure a trustworthy AI ecosystem, the European Union has introduced the AI Act, the world’s first comprehensive legal framework on AI. This article provides an in-depth understanding of the AI Act, its classifications, obligations, and implementation.

What is the AI Act?

The AI Act is a pioneering legal framework establishing clear requirements and obligations for AI developers and deployers. It aims to mitigate the risks associated with specific AI applications while fostering innovation and trust in AI technologies. 

The AI Act is part of a broader package of policy measures, including the AI Innovation Package and the Coordinated Plan on AI, to guarantee the safety and fundamental rights of individuals and businesses in the context of AI.

The AI Act’s Risk-Based Approach

The AI Act adopts a risk-based approach, classifying AI systems into four categories based on their potential impact: unacceptable risk, high risk, limited risk, and minimal risk.

Unacceptable Risk: The AI Act prohibits AI systems posing unacceptable risks, such as social scoring systems and manipulative AI. 

High Risk: Highly regulated high-risk AI systems include AI used in critical infrastructures, education, employment, essential public and private services, law enforcement, migration, asylum and border control management, and administration of justice and democratic processes. 

Limited Risk: AI systems with limited risk are subject to lighter transparency obligations. Developers and deployers must ensure that end-users know they are interacting with AI. 

Minimal Risk: Most AI applications currently available, such as AI-enabled video games and spam filters, are not regulated and fall under the minimal risk category.

Obligations for AI Developers and Deployers

Most of the obligations under the AI Act fall on providers or developers of high-risk AI systems. These include establishing a risk management system, ensuring data governance, designing their system for record-keeping, providing instructions for use to deployers, and establishing a quality management system. 

Users, or deployers, of high-risk AI systems also have some obligations, though less than providers. This includes users in the EU and third-country users whose output is used in the EU.

General Purpose AI (GPAI) 

The AI Act also addresses GPAI models capable of performing various tasks. 

All GPAI model providers must provide technical documentation and instructions for use, comply with the Copyright Directive, and publish a summary of the content used for training. 

Implementation and Governance of the AI Act

The European AI Office, established within the Commission, will implement and monitor the AI Act and handle complaints regarding its infringement. 

With the AI Act, the EU has taken a significant step towards creating a trustworthy and regulated AI environment. 

The Act provides guidelines and requirements for AI developers and deployers to ensure that AI technologies respect human dignity, rights, and trust.
